1. Acceptance of Terms

By downloading, installing, or using the Mbiyyo Rides mobile application or website (collectively, the "Platform"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years old to use Mbiyyo Rides as a rider. Drivers must meet additional eligibility requirements including a valid driver's license, vehicle registration, background check, and insurance verification. We reserve the right to suspend or terminate accounts that do not meet these requirements.

3. Services

Mbiyyo Rides provides a technology platform that connects riders seeking transportation with independent drivers who use their own vehicles. We do not provide transportation services directly.

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. We are not liable for any loss or damage arising from your failure to secure your account.

5. Payments & Cancellations

• Fares are calculated based on distance, time, demand, and applicable fees.
• Payments are processed through our secure payment partners.
• Cancellation fees may apply if a ride is cancelled after a driver has been dispatched.
• Promotional codes and discounts are subject to specific terms and expiry dates.

6. Prohibited Conduct

Users may not:

• Use the Platform for any illegal or unauthorized purpose
• Harass, threaten, or discriminate against drivers, riders, or staff
• Damage, tamper with, or steal any vehicle or property
• Create fake accounts or impersonate another person
• Attempt to bypass or interfere with Platform security measures
• Smoke, consume alcohol, or use drugs during rides

7. Limitation of Liability

Mbiyyo Rides is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Platform. Our total liability shall not exceed the amount you paid for the specific ride giving rise to the claim.

8. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Tanzania.

9. Termination

We may suspend or terminate your account immediately, without notice, for conduct that we believe violates these Terms or is harmful to other users, drivers, or the Platform. You may also delete your account at any time through the app settings.
